Property Line Adjustment

A “Property line adjustment” means a relocation or elimination of all or a portion of the common property line between abutting properties that does not create an additional lot or parcel. This adjustment must be approved by the applicable local government, such as a city or county, and is governed by ORS 92.010 to 92.192

For land located entirely outside the corporate limits of a city, a county may approve a property line adjustment even if one or both abutting lawfully established units of land are smaller than the minimum lot or parcel size for the applicable zone before the adjustment, provided that after the adjustment, one of the units is as large as or larger than the minimum size required However, on land zoned for exclusive farm use, forest use, or mixed farm and forest use, certain restrictions apply. A property line adjustment may not be used to decrease the size of a unit of land that contains an existing dwelling or is approved for the construction of a dwelling if another unit would be increased to a size qualifying it for a dwelling

Furthermore, a property line adjustment may not be used to allow an area of land used to qualify a unit of land for a dwelling based on an acreage standard to be used to qualify another unit for a dwelling if the land use approval is based on an acreage standard Additionally, adjustments resulting from a subdivision or partition authorized by a waiver are limited; affected units cannot be increased in size beyond two acres if the land is high-value farmland, high-value forestland, or within a ground water restricted area, or beyond five acres otherwise

The adjustment process requires a survey and monumenting in accordance with ORS 92.060, and a survey complying with ORS 209.250 must be filed with the county surveyor The adjustment must also be recorded in the deed records of the county where the property is located The property line adjustment must be documented with a Record of Survey and property line adjustment deeds, which are prepared by a private surveyor after final review and approval.
